SCRAM® and the Law

As of February, 24, 2004, Alcohol Monitoring Services has provided support in court cases, hearings and other proceedures involved with SCRAM, as the following summary notes indicate.

Washtenaw County Michigan-Circuit Court

Client obtained PBTs on Friday and Saturday mornings to try and show he was not drinking. Events seen later on days he obtained readings. Bracelet showed compliance at time of PBT but drinking later in day. Client sentenced to 1 year.

Trend analysis of client enabled the report to show a pattern of non-compliance.

41-B District Court Probation Detroit, Michigan

Client claimed interferants in workplace created positive readings. Interferants were posted but AMS showed the difference between interferant readings and the predictable Blood Alcohol Curve. Client sentenced to 30 days followed by additional 6 months on SCRAM.

Orange County South Drug Court

June 2003 Positive Detection. Client Pleaded. 6 months in County and return to SCRAM upon release.

June 2003 Positive Detection. Client denied. Ordered on for last 2 months of probation. No further positives detected.

Aug 2003 Positive detection. Client taken into custody immediately.

Eight other confirmed events resulted in additional treatment through service provider.

Michigan Department of Corrections

Four clients were identified as attempting to defeat the SCRAM bracelet. All admitted to attempts to defeat. Eight positive detections from Nov. 2002-May 2003. All but 1 admitted and received additional sanctions.

Washtenaw County Court. Client found to have violated terms of parole (consumption of alcohol). Found to have removed bracelet.

House Arrest Service-Detroit.Hearing at 40th District court in which SCRAM showed positive drinking. At hearing client admitted.

Eaton County Drug Court. Client failure to follow requirements of upload schedule. 5 days in County and additional time on SCRAM.

Fourteen others taken to hearing however disposition unknown as AMS support was not requested.
